Booking Terms and Conditions

The purchase of a trip customized by Always Aloha Travel represents your acceptance of these terms.

USE OF THIRD-PARTY SUPPLIERS. In making reservations and other travel arrangements on behalf of its customers, Always Aloha Travel acts as an agent of various third-party suppliers, such as airlines and hotels, who are independent of Always Aloha Travel.  Such third-party suppliers are exclusively responsible for providing services contracted for, including, but not limited to, transportation, lodging, and meals. Always Aloha Travel maintains no control over the operation, equipment, or personnel of such suppliers and therefore assumes no liability or responsibility for any personal injury, property damage, or other loss, accident, delay, or inconvenience caused by any wrongful or negligent act or omission on the part of any service provider. You agree to look solely to the actual suppliers of the services for any remedy in the event of any loss, damage, injury, or claim.

PAYMENT TERMS.  Always Aloha Travel accepts payments via credit card or PayPal.  In providing payment to Always Aloha Travel via credit card to book your trip, you attest that (1) the credit card information you supply to us is true, correct, and complete; (2) you are duly authorized to use such credit card for the purchase; (3) charges incurred by you will be honored by your credit card company; and (4) you will not initiate a chargeback.  Always Aloha Travel’s policy is that the credit card(s) being used as the form of payment for the trip be one of the confirmed travelers on the itinerary.  If a third-party payment is being used then we require a credit card form to be filled out along with a copy of the credit card and photo ID that matches the name on the credit card.  Mahalo for your understanding.

TRAVEL DOCUMENTS. It is the passenger’s responsibility to have a valid and current government-issued identification. You agree that Always Aloha Travel is not responsible if you do not have the correct documentation for your trip.

SATISFACTION. By purchasing travel arrangements customized by Always Aloha Travel and agreeing to these terms and conditions, you give Always Aloha Travel permission to take control over your travel itinerary. As such, you acknowledge the inherent risk that you may be dissatisfied with the arrangements or other aspects of either the Surprise or Traditional vacations.  Always Aloha Travel is not liable if you are dissatisfied with your trip and will not offer refunds under these circumstances.

CANCELLATIONS AND RESCHEDULING. Our “No Worries” Cancellation gives you the peace of mind that you have someone looking out for you!  If you need to cancel or reschedule your trip, we will assist you in securing any refunds and/or travel credits you are owed by airlines, hotels, and any other suppliers and vendors. Where applicable, these refunds and/or travel credits will be retained as travel credit with Always Aloha Travel to be used to rebook your trip at a later date. You will remain responsible for any cancellation fees imposed by the suppliers and vendors. In addition, you will remain responsible for payment of Always Aloha Travel’s service fee(s) for the work done to research, plan, and book your trip, as well as seek any applicable refunds on your behalf in the case of cancellation.

LIABILITY. Always Aloha Travel will not be liable or responsible, nor deemed to have defaulted or breached these terms, for any failure or delay in our performance when such failure or delay is caused by or results from acts or circumstances beyond our reasonable control, including acts of God, flood, fire, earthquake, explosion, governmental actions, war, invasion or hostilities (whether war is declared or not), terrorist threats or acts, riot or other civil unrest, national emergency, revolution, insurrection, epidemic, pandemic, lockouts, strikes or other labor disputes, or restraints or delays or inability or delay in obtaining supplies of adequate or suitable materials, materials or telecommunication breakdowns, or power outages.

ATTORNEY FEES. In the event of an action to enforce this agreement or to seek remedies for breach of this agreement, including the failure to make timely payment, the prevailing party shall be entitled to recover from the other party its costs, disbursements, and reasonable attorney fees.

GOVERNING LAW AND JURISDICTION. This agreement and any disputes arising in connection herewith shall be governed by the laws of the State of Hawaii without regard to its conflicts of laws principles. All actions relating to this agreement shall be brought and tried in the state or federal courts of Hawaii.  The parties hereby consent to submit to the personal jurisdiction of such court and to the venue therein.

LIMITATION OF LIABILITY. To the fullest extent permitted by law, Always Aloha Travel shall not be liable to you for any claims for damages, including punitive, indirect, direct, speculative, or any other form of cognizable damage beyond the total amount paid by you for the services provided hereunder.
